The protection of the principle of progressivity. A question of rights and not rules

Abstract
The dignity of the person is the basis without which it is impossible to speak of a legal system where fundamental rights are valid. This essay seeks to demonstrate that this judicial protection must reestablish the status obtained in the protection of rights, beyond the source from which it arose, since what is relevant is the degree of satisfaction obtained and not the authority that has recognized it, since that the State must be considered as a whole in which the various agencies that make it up do not generate differences regarding the validity of rights. If dignity of people is a starting point, it is irrelevant that the protection of rights derives from an agreement, a sentence; a regulation or a law or even the constitution since the important thing is that, once recognized, the degree of protection it generates in favor of people is always respected as a minimum required.
