Decision of the Inter-American Court of Human Rights “Caso Tzompaxtle Tecpile y otros contra México”: repercussions on mandatory custody

Abstract
At the end of 2022, the Inter-American Court of Human Rights convicted Mexico for violations of the American Convention in the application of “arraigo” and “prisión preventiva” (custody). For this reason, this commentary, on the one hand, reviews the Court’s arguments to reach that decision and, on the other hand, applies that reasoning to the current figure of prisión preventiva oficiosa (mandatory custody) to assess its conformity with international standards.
